Terms of Use – Jerusalem Theatre for the Performing Arts (Public Benefit Company)

Welcome to the official website of the Jerusalem Theatre for the Performing Arts (PBC) (hereinafter: "Jerusalem Theatre" and "The Theatre"), which appears at https://www.jerusalem-theatre.co.il/ or any other platform (all together referred to as "The Site."

Use of the Site is subject to the Terms of Use detailed below and constitutes the user's (hereinafter, "the user", "you") consent to the Terms of Use. If you do not agree to any provision appearing in the Terms of Use, you must immediately cease using the Site. By performing any action and/or using the Site, you declare that you have read the Terms of Use carefully before performing it, and you give your consent to all its provisions and conditions, and that you or anyone on your behalf will not have any claim and/or demand in relation to the Terms of Use.

1. General

1.1 The purpose of the Terms of Use is to regulate the relationship between the Site and any body and/or entity and/or party or any person acting on behalf of those who use the Site.

1.2 On the Site, you can find information and data about various services and products provided by the Jerusalem Theatre and/or third parties (collectively, "the services"). For example, the services include, among other things, booking tickets for plays, shows, performances, films, and other events staged at or on behalf of the Jerusalem Theatre. In addition, through the Site, you can subscribe to the Jerusalem Theatre's mailing list and receive promotional mailings and updates on topics of your choice, including films and cinema events and/or promotions, subscriptions, plays and performances subject to the terms detailed in the privacy policy appearing here (hereinafter: the "Privacy Policy"). The Theatre's computer records will constitute prima facie evidence that the data appearing therein is the data you have provided.

1.3  The Site has a personal area that includes user/subscription details, past orders, future orders, and the ability to manage orders. The personal area is part of the Site, and the Terms of Use apply to it.

1.4 The Jerusalem Theatre may change the Terms of Use of the Site from time to time, at its sole discretion, without providing prior notice. The changes will take effect upon publication and apply retroactively to all site users. The Jerusalem Theatre suggests staying up to date on these changes regularly.

1.5 The Terms of Use will apply to the use of the Site on any computer or other communication device that you find appropriate (cell phone, tablet, laptop, etc.).

2. Right of Use:

2.1. Use of the Site and services is free for all registered on the Site and those who have ordered in the past or plan to order in the future.

2.2. Use of the Site and its contents is on an AS IS basis and on an AS AVAILABLE basis. You will not have any claim against the Jerusalem Theatre or, request or demand thereof, and/or anyone on its behalf regarding the features of the Site and the contents, the correctness of the contents, their completeness, their timeliness and accuracy, the capabilities of the Site, limitations or adaptation of the Site and the contents to your needs, including for their termination (temporary or permanent), failure to save and/or loss of contents, including those sent to you or by you, as well as damage to or disruption of the integrity or content of contents that you have received or transmitted. The Jerusalem Theatre does not undertake to provide program support for any malfunction and/or disruption mentioned above.

2.3. The Jerusalem Theatre does not warrant that all of the services offered on the Site or that will be provided on it will continue to be provided, and one or another service may be denied without prior notice and in accordance with the law.

2.4. The Jerusalem Theatre does not warrant that the use of the Site and the services included therein (including when ordering tickets) will not be impeded, interrupted, or barred from illegal access to the Jerusalem Theatre computers and/or that they meet your requirements. Despite the efforts made, the Jerusalem Theatre does not warrant that any defect or deficiency on the Site will be corrected. The Jerusalem Theatre will not be liable for any damage, direct or indirect, emotional distress, etc. that may be caused to you or your property as a result. You will not have any claims in this regard.

3. Prohibited Activities

To protect the Site, you, the Jerusalem Theatre, and third parties are prohibited from performing the following actions:

3.1. Impersonating any person or entity, including a representative, employee, or manager of the Jerusalem Theatre and/or a person with a certain characteristic, to obtain a discount on a subscription or providing a misrepresentation or false representation of a relationship between you and a third party.

3.2. Posting, sending, or transmitting any false or misleading material or information intended to deceive any person or entity, directly and/or indirectly.

3.3. Posting, sending, or transmitting any material that contains any computer virus or any other computer code designed to destroy, interrupt, or limit the use (including any use other than fair and reasonable use of the service) of any of the computers, servers, hardware, and/or software used by the Jerusalem Theatre to provide the services offered on this Site. Likewise, you may not operate or allow the operation of any computer application or any other means, manual or automatic, including robot, spider, agent, crawler, etc., for the purpose of entering the Site, collecting information both in general and systematically, searching, scanning, copying, extracting information, or automatically retrieving content from the Site.

3.4. Distributing "spam" to the Site's servers or through the Site, or distributing it by any other mailing methods.

3.5. Modifying, processing, copying, extracting information, adapting, granting a sublicense, translating, selling, performing reverse engineering, dismantling, or reassembling any of the parts of the code that make up the Site, including the database, as well as such actions regarding the hardware and software used for the service.

3.6. Infringing in any way the copyrights, trademarks, or any other proprietary right of the Jerusalem Theatre and/or of any third party on this Site.

3.7. Use intended to track or harass another person in any way.

3.8. Overburden any of the Site's or Jerusalem Theatre's systems.

4. Intellectual Property and Copyrights

4.1. The Site contains or may in the future contain intellectual property and copyrights that belong to Jerusalem Theatre or anyone on its behalf (for example, software, applications, computer codes, graphic files, texts, domain names, trade secret rights and trademarks, its design and graphic elements appearing therein, and any other material). You must assume that the materials displayed on the Site are protected by intellectual property laws, including Copyright Law, 2007, unless otherwise stated.

4.2. You may not sell, reproduce, copy, distribute, modify, broadcast, publicly display, publicly perform, process, publish, rent or deliver to a third party, whether through you or through a third party, any part of the materials on the Site, or make any other commercial or public use of them, in any way or means, whether electronic, mechanical, optical, photographic, or audiophonic, without obtaining the Jerusalem Theatre's prior written consent.

5. Placing orders and joining the Jerusalem Theatre's mailing list

5.1. To place an order or register on the Site, you will be asked to provide various details, such as your first and last name, full address, including street name, house number, apartment number, town, and zip code, telephone number for contact purposes, email address, or credit card details in your possession. (hereinafter: "Personal Information"). The details you must provide to place an order or register will be explicitly marked in the appropriate fields (hereinafter, "Mandatory Fields"). You will not be able to place an order or register on the Site unless you fill in the mandatory fields. Personal information will be stored in accordance with the JT Privacy Policy.

5.2. The tickets will be ordered using a credit card or a subscription card. When ordering tickets with a credit card, you will be charged the full order amount. Confirmation of the transaction by the credit card company used for the purchase will be required to process your request.

5.3. Upon completion of the order, a confirmation will be sent to the email address you've provided, including the order details and a notification asserting that the order was successfully placed. You can attend performances at the hall without going through the Theatre box office, simply by using your subscription card or the card(s) emailed to you and printed in advance.

5.4. An SMS message containing the details of the performance you've booked at the box office or on the Theatre's website will be sent to you on the day before the performance.

5.5. Please ensure that your mobile phone number is up-to-date with the Theatre's records.

6. Cancellation Policy

6.1. Reservations can be canceled by phone, email, chatbot, personal area, and at the Theatre's box office up to 48 hours from the start of the performance for which the reservation was made. Cancellation of an order will be made in accordance with the provisions of the Consumer Protection Law, 1981, and the regulations enacted thereunder, as amended from time to time in accordance with current legislation.

6.2. Providing false information may result in legal action. Jerusalem Theatre reserves the right to cancel or not approve an order due to the provision of false information or failure to provide complete details.

6.3. Jerusalem Theatre may prevent you from placing an order through the website if you have intentionally provided incorrect information, and/or committed an act or omission that may harm Jerusalem Theatre and/or violate Jerusalem Theatre's Terms of Use, and/or have unlawfully failed to pay, and/or if your credit card has been blocked or restricted.

6.4. Cancellation of a subscription order – You can request to cancel a subscription by email, phone, or chatbot, and the cancellation will be made through the Theatre's box offices, up to two weeks from the date of the order, provided that the subscription has not been used and/or the date of the event(s) in the subscription(s) has not yet taken place. The refund will be made by crediting the credit card used to pay for the subscription(s) or by check. A 5% cancellation fee will be deducted from the refund. Cancellation of an order will be made in accordance with the provisions of the Consumer Protection Law, 1981, and the regulations enacted pursuant thereto, as amended from time to time in accordance with current legislation.

7. Links

7.1. The Jerusalem Theatre is not responsible for the content of the sites to which there are links on its Site, and the quality of the service provided on them. The JT will not bear any liability in connection with these sites. The links on the Site should not be considered a recommendation for their use; they are provided for your convenience only.

8. Email

8.1. The Site offers the option of sending emails to the Jerusalem Theatre. For the information of senders, the emails you receive are not confidential. They are visible to employees of the Jerusalem Theatre and may also be shared with third parties for processing.

9. Indemnity

9.1. Upon first demand, you will indemnify the Jerusalem Theatre, its employees, office holders, partners, shareholders, subsidiaries, consultants, suppliers and those acting on its behalf for any claim, demand, damage, loss, payment or expense incurred by them – including reasonable attorney's fees and legal costs – due to a breach of these Terms of Use and/or a violation of the law by you or anyone on your behalf and/or a claim and/or demand by any third party as a result of any breach of the Terms of Use of the Site.

10. Personal Information

10.1. The Site processes personal information as detailed in the Privacy Policy.

11. Additional Terms

11.1. Without derogating from the foregoing, the Jerusalem Theatre shall be entitled to provide additional data, services, and/or products on the Site and/or to discontinue or cancel any data, service, and/or product that is currently available, or that will be available on the Site in the future. Furthermore, the Jerusalem Theatre has the right to establish additional or alternative terms that will apply to any data, service, and/or product, current or future, available on the Site ("Additional Terms"). Unless otherwise stated, the additional terms will be considered an integral part of the Terms of Use.

12. Liability

12.1. The Jerusalem Theatre is not responsible in any way for defects and/or deficiencies and/or errors of any kind in the information that appears on the Site.

12.2. The Jerusalem Theatre is not responsible in any way, directly or indirectly, for any damage and/or loss, direct or indirect, resulting from the use of the Site and/or its contents and/or services or resulting from the inability to use the Site, for any reason whatsoever. Furthermore, the Jerusalem Theatre will not be liable for any damage to software or other property caused by the use of the Site.

12.3. Jerusalem Theatre does not warrant that the Site and/or its use meet or will meet any need of users, and it will not be liable for adapting the information to the user's needs.

12.4. Without derogating from the foregoing, even if Jerusalem Theatre and anyone on its behalf is found to be liable for any damage, the amount of compensation and the User's exclusive remedy with respect to any dispute related to the Site and/or its content and/or the Services shall be limited to the amount paid by the User to Jerusalem Theatre for such use (if any).

13. Dispute Resolution

13.1. The applicable law in all matters relating to these Terms of Use and their interpretation shall be Israeli law (without regard to Dépeçage rules). Furthermore, the competent court in the city of Jerusalem shall have the sole and exclusive jurisdiction in all matters relating to these Terms of Use.
